TipHaus Privacy Policy

Introduction

TipHaus Inc. (“we” or “TipHaus”) is committed to respecting individual privacy. This Privacy Policy reflects our dedication to handling personal data in accordance with current data protection laws, including the European General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA) and its successor, the California Privacy Rights and Enforcement (CPRE), and other relevant legislation. “Personal Data” refers to any information that identifies, relates to, describes, or can be associated with a particular individual, or as otherwise defined under relevant legislation. Unless otherwise defined in this policy, terms carry the same meaning as used in our Terms of Use or in applicable data privacy legislation.We update this Privacy Policy periodically and display changes on this page.

This Privacy Policy explains how we handle your Personal Data when:

  1. Your organization registers for our Services and you access TipHaus with a business account.

  2. You create an individual account for our Services that is not linked to an organization, or continue using individual features of the Services after leaving an organization.

  3. You visit our website (www.TipHaus.com) or its subdomains.

  4. You contact our customer service or sales teams by phone.

  5. You otherwise provide Personal Data to us.

1. TipHaus as Data Controller and Data Processor

We primarily collect and use Personal Data to provide our Services to you or your organization. When processing Personal Data on behalf of your organization, we act as a “data processor” under data protection laws. For website visitors, phone users, and others interacting with us outside of a contractual business relationship, we act as a “data controller.” See section 4 for more details.

2. Types of Personal Data Collected

We will determine whether an error occurred within ten (10) business days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to forty-five (45) days to investigate your complaint or question. If we decide to do this, we will provide you with a provisional credit to your account within ten (10) business days for the amount you think is in error so that you will have use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within ten (10) business days, we may not provide a provisional credit to your account.

2.1 Service Users

We collect Personal Data necessary for providing and improving our Services, which may include:

  2. Phone number

  3. Date of birth

  4. Credit card or billing information

  5. Email address

  6. Business address

  7. Profile photo

  8. Any Personal Data in files you upload or create (“Files”)

  9. Device log data and usage activity

Creating an account and employee profile requires submitting Personal Data, which remains linked to your account as long as it is active. We do not collect Sensitive Personal Information, as that term is defined under applicable data privacy law.

2.2 Website Users

We collect limited Personal Data to improve website experience:

  1. Device log data

  2. Name, email, phone number, and company name (for marketing activities or inquiries)

2.3 Phone Users

For call recordings, we collect:

  1. Name

  2. Phone number

  3. Email address

Recordings are used to enhance service quality and identity verification.

3. Methods of Collecting Personal Data

3.1 Service Users

Personal Data is collected through:

  1. Information you provide during account setup or Service use

  2. Data received from your organization

  3. Employment information entered by you or your organization

  4. Automatic collection via devices, service usage, and cookies

3.2 Website Users

Automatically collected data includes log data and information from marketing activities, as well as cookies. We may also collect Personal Data you provide by entering it into a form on our website.

3.3 Phone Users

Call recording notifications and purposes are disclosed at the start of each call.

4. Use of Personal Data

4.1 Service Users

We use Personal Data to deliver the TipHaus Services by:

  1. Enabling access and usage of our application

  2. Providing technical support

  3. Personalizing your experience and software updates

  4. Ensuring contract compliance

We may also use Personal Data to:

  1. Announce products or services

  2. Offer services outside TipHaus

  3. Ensure legal and regulatory compliance

  4. Defend legal claims

  5. Analyze usage statistics to improve our Services

4.2 Website Users

Data is used to improve the website experience and offer you products and services.

4.3 Phone Users

Personal Data from calls is used to improve customer service and verify identities.

4.4 General Users

We may use your Personal Data as collected above for any legitimate business purpose in accordance with applicable and with your specific consent. TipHaus does not offer price or service differences related to the collection/sale/retention of Personal Data.

5. Sharing and Disclosure of Personal Data

We may share Personal Data:

  1. Within your profile and organization, depending on access levels

  2. With trusted contractors, suppliers, vendors, or service providers for operations like data storage, analytics, and payment processing

  3. With business partners, agents, and third-party applications (with your consent)

  4. To comply with laws or protect TipHaus’s rights

  5. During business transfers (mergers, acquisitions)

  6. For non-private or aggregated data

6. Your Privacy Rights

TipHaus provides all data subjects with certain rights concerning their Personal Data. These include but are not limited insofar as applicable data privacy legislation affords additional rights:

  1. Access and Data Portability: You may request to know what Personal Data we have collected about you and request a copy.

  2. Deletion (Right to be Forgotten): You may request the deletion of your Personal Data, subject to certain exceptions.

  3. Rectify: You may request that any errors to your Personal Data be rectified.

  4. Opt-Out of Sales: You may opt out of the sale of your Personal Data (Note that TipHaus does not sell Personal Data).

  5. Non-Discrimination: We will not discriminate against you for exercising your privacy rights. We will not:

    1. Deny you goods or services.

    2. Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.

    3. Provide you a different level or quality of goods or services.

    4. Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

    To submit a request under these rights, email support@TipHaus.com. Verification is required before fulfilling requests. We aim to respond within 45 days and will respond to requests received within the previous 12 months. Fees may be charged for excessive requests. If you have unresolved concerns, you may also have the right to lodge a complaint with a supervisory authority, depending on your location.

7. Safeguarding Personal Data

We use technical and organizational measures to protect Personal Data from misuse and unauthorized access, including SSL and TLS encryption for payments and encrypted call recordings.

8. Data Retention

We retain Personal Data only as long as necessary for our agreements, legal obligations, and legitimate business interests, subject to applicable law. Once no longer needed, Personal Data is deleted or put beyond use. Call recordings are stored for up to three years.

9. International Data Storage and Transfer

Personal Data may be processed or stored outside the EEA for purposes of processing as set forth in this policy, primarily in the USA and Canada, with encrypted transfers and backups. We comply with all international data transfer laws, and any such transfers shall be subject to the GDPR standard contractual clauses, adequacy assessments, or other transfer mechanisms pursuant to applicable data privacy law.

11. Legal Bases for Processing Personal Data

We process data based on:

  1. Contractual obligations.

  2. Legitimate interests in enforcing our Terms of Use or improving our Services.

  3. Your explicit consent (for certain activities and third-party sharing). Consent can be withdrawn at any time.

12. Children and Minors

TipHaus does not knowingly collect Personal Data from children under 16, in compliance with COPPA regulations and GDPR.
